Seres Therapeutics (“Seres”, “we”, “us” and “our”), the sponsor of the Ecospor SER-109 study (the “Study”) and the owner and manager of the Study website, services and applications (the “Service”), is committed to ensuring compliance with applicable legislation which protects the personal information of the Service users ("User", "Users", "you", or "your") that will be collected, used, and disclosed during your participation in the Study. This Privacy Notice (“Privacy Notice”) explains and governs how we collect, use and disclose information and data through your use of the Service and your engagement with the Study. 

By using the Service, you are agreeing to this Privacy Notice and the Service’s Terms of Use. If you do not want us to collect, use or disclose information and data in the ways identified in this Privacy Notice, do not use the Service.

The short descriptions provided in the table below provide a high-level summary of our privacy practices more comprehensively set out thereafter. You should read the Privacy Notice in full in order to fully understand what and how information and data will be collected, used, disclosed and stored when you use the Service.

 “Personal Information” is information that can be used to uniquely identify you.

Capitalized terms not defined here have the meaning ascribed in the Terms of Use.


By using the Service, you consent to your information and data (including Personal Information) being collected, used, retained, disclosed and stored by us as described in this Privacy Notice.

Collection and Use

We collect and use your Personal Information to create your profile, to determine eligibility for the Study, to contact you about participating in the Study, to identify you in the Study, to provide you with information about the Study, to provide technical support, and for internal business purposes. We may use information derived from your profile in a form that does not identify you individually to monitor and understand system usage, improve system design, perform statistical analyses, and generate data related to how you use the Service.


When you click "See Results Now", you provide explicit permission for us to disclose your Personal Information to third party Study facilitators, such as the clinical research team. We may also disclose your Personal Information to third parties acting on our behalf to deliver the Service. Personal information may also be disclosed where permitted or required by law.


We keep your Personal Information for one year after the Study ends or until you ask us to delete your Account. Deleting your Account permanently deletes your identifiable information, so if later you decide you wish to be considered for the Study, you must create a new Account .


You are responsible for keeping your Personal Information up to date and accurate.


We use industry standard security practices appropriate to the sensitivity of the Personal Information to protect your Personal Information.


Seres is located in the U.S. and uses third-party contractors located in the U.S. and in Canada. Your Personal Information may be collected, handled, processed and stored in either country.

Individual Access

You can review, edit or remove your Account and your Personal Information at any time.

Additional Information

No internet or email transmission is ever fully secure or error free and no security system is impenetrable. We cannot guarantee confidentiality or the security or privacy practices of other Services.


Privacy Officer

We will inform you of why and how we collect, use and disclose Personal Information, obtain your prior consent where required, and only handle your Personal Information in a manner that a reasonable person would consider appropriate in the circumstances. 

We have Privacy Officers accountable for maintaining privacy programs that comply with applicable legislation. Our privacy commitments include ensuring the accuracy, confidentiality, and security of your Personal Information and allowing you to request access to, and correction of, your Personal Information. 

Types of Personal Information We Collect, Use and Disclose

Personal Information about Users, such as:

  • Name;
  • Email address;
  • Phone number (optional);
  • Biographical (i.e. gender, age, location);
  • Condition/disease (i.e. diagnosis date, surgery plans, symptoms);
  • Treatment information (i.e. current treatments, past treatments); and
  • Other potentially relevant personal health information.

 We collect the name, email address, phone number and image of those researchers authorized to view the Accounts of patients.

Collecting Personal Information

Unless the purposes for collecting Personal Information are obvious and you voluntarily provide your Personal Information for those purposes (which purposes include providing the Service), we will communicate the purposes for which Personal Information is being collected, either orally or in writing, before or at the time of collection.

Your Personal Information will be collected by us and disclosed to third-parties that we contract with to provide certain parts of the Service on our behalf (such as Discover Therapies Inc.) (“Contractors”). We contractually require such Contractors to safeguard your Personal Information. We remain solely responsible to you for the Service and the security of your Personal Information.

We will only collect Personal Information that is necessary to fulfill the following purposes:

  • To create your Account.
  • To assess and compare your profile against the pre-screening criteria for the Study.
  • To contact you to complete a phone screen.
  • To contact you about participating in the Study. For example, we use your email address to notify you about your eligibility for the Study.
  • To identify you in the Study.
  • To contact you with updates and notifications relating to the Study.
  • To provide technical support or respond to inquiries, when requested by you; and
  • For internal business purposes.

We may also collect “De-identified Data”, data that does not identify an individual, generated by your use of the Service. You understand and agree that we own any De-identified Data collected by us, and as a result, we may use it, share it and exploit it in any manner determined in our sole discretion from time to time.

The Service is not meant for children and minors. We do not intentionally collect information about people under 18 years old and are not able to include people under 18 years of age in the Study.


By using the Service, you consent to your information and data being collected, used, disclosed and stored by us, as described in this Privacy Notice.

At any time after you create your Account and without penalty, you can withdraw your consent and delete your ACcount by accessing the "settings" tab on your Account or by contacting us at Your Personal Information will thereafter be deleted from our databases. 

Deleting your Account permanently deletes your Personal Information from our active database. Once your profile is deleted we cannot match you to the Study, so if you later change your mind and decide you wish to participate, you must create a new Account.

You can opt-out of most email communication from us by clicking on the unsubscribe link at the bottom of our emails. As long as you are participating in the Study, we may still contact you for administrative purposes, for example to notify you of a change to the Study, change to the Privacy Notice, or if there is a service interruption.

We may collect, use or disclose Personal Information without your knowledge or consent in certain circumstances, including but not limited to:

  • When the collection, use or disclosure of Personal Information is permitted or required by law;
  • In an emergency that threatens an individual's life, health, or personal security;
  • When the Personal Information is available from a public source;
  • When we require legal advice from a lawyer;
  • For the purposes of collecting a debt;
  • To protect ourselves from fraud; and/or
  • To investigate an anticipated breach of an agreement or a contravention of law. 

Using and Disclosing Personal Information

We will only use or disclose Personal Information where necessary to fulfill the purposes identified at the time of collection or for a purpose reasonably related to those purposes. For certainty, you hereby consent to our using your Personal Information to deliver the Service to you, to improve the Service and/or the Study, to communicate with you with regards to the Service and/or the Study, and for internal statistical, marketing or operational purposes.

When you click "See Results Now", you provide explicit permission for us to disclose your Personal Information to third party Study facilitators, such as the clinical research team. You also hereby consent to our disclosing your Personal Information to Contractors that are contractually engaged by us to provide certain parts of the Service on our behalf. Such third parties (including Contractors) will be under strict legal constraints governing the disclosure of your Personal Information, and may contact you directly in connection with the Study. We remain responsible to you with respect to each such third party’s acts and omissions. The Service is a matching service only, and we make no decisions about acceptance and participation in the Study.

We will also use Personal Information to:

  • Assist you with technical support issues. Most technical issues can be resolved without our support team viewing your personal information.
  • Comply with any laws, regulations, court orders, subpoenas, or other legal process or investigation and to protect ourselves and other individuals as permitted by law.
  • Assist in due diligence relating to any corporate action such as a financing, merger, amalgamation, sale or divestiture. 

Retaining Personal Information

Personal information provided by Users, including those who do not meet criteria for participation in the Study, will be kept for one year after the Study ends, at which time the data will be made anonymous and become De-Identified Data (as defined herein). 

Subject to the above, we will retain Personal Information only as long as necessary to fulfill the identified purposes or a legal or business purpose.

Ensuring Accuracy of Personal Information

We rely on you to ensure that the Personal Information you provide for the Study through the Service is accurate, complete and up-to-date. You are welcome to make changes and request deletion or corrections to Personal Information at any time by updating your Account and settings or by contacting us at

Securing Personal Information

We use industry standard security practices appropriate to the sensitivity of the Personal Information and take reasonable steps to protect your Personal Information from unauthorized access, collection, use, disclosure, copying, modification or disposal or similar risks. We train our teams to follow privacy and security practices, including the principles of privacy by design.

Using contracts, we ensure that third parties acting on our behalf (including without limitation, Contractors) maintain reasonable and appropriate safeguards in respect of your Personal Information. Third parties acting on our behalf are not permitted to use or disclose your Personal Information for any purpose other than those relating to the Service or identified in this Privacy Notice.

We will use appropriate security measures when destroying Personal Information.

We will review and update our security policies and controls as technology changes to ensure ongoing Personal Information security, however please bear in mind that no internet or email transmission is ever fully secure or error free and no security system is impenetrable. We cannot fully guarantee the confidentiality of any information that you share with us.

Location of Service

Seres is located in the U.S. and contracts with third parties (such as the Contractors) that may be located outside of the U.S. Your personal information may be processed and stored in outside of the U.S. and therefore may be subject to disclosure under the laws of jurisdictions in multiple countries. Individual Access

You own the Personal Information you submit for the Study and can review, edit or remove it at any time subject to limited exceptions. Upon written request, we will provide you with a list of entities (e.g. third party service providers) to whom we have disclosed your Personal Information, if applicable. 

Cookies and Other Tracking Technologies

We use cookies to improve your experience, to save you time, and to make it possible to navigate the Service. We do not link the information we store in cookies to any Personal Information you submit while participating in the Study. You can remove cookies manually by following directions provided in your Internet browser’s "help" file. If you refuse cookies, you will not be able to use some or all of the Service, since some cookies are essential to navigation.

Email is not a secure method of communication. We cannot guarantee the security of email messages you send to us.

It’s important to guard your privacy when you are online. If the Service contains links to other Services, this Privacy Notice does not govern those Services. Whether we have posted those links or other organizations or individuals have, you should read their privacy policies and make an informed decision about whether you want to use those Services or their services.
